Welcome to our social network website and mobile app Hypefeed ("the Platform") for photo sharing and map making. The Platform is only available to users who are eighteen (18) years of age or older. By using the Platform, you agree to be bound by these terms and conditions of use ("Terms") and our Privacy Policy. If you do not agree to these Terms, you should not use the Platform.

1. Age Requirement

1.1 The Platform is intended only for individuals who are at least eighteen (18) years of age.

1.2 By creating an account or using the Platform, you represent and warrant that you are eighteen (18) years of age or older.

1.3 If you are under the age of eighteen (18), you must not use the Platform or create an account.

1.4 We reserve the right to suspend or terminate any account that we reasonably believe is being used by a person under the age of eighteen (18).

2. User Conduct

2.1 You are solely responsible for your use of the Platform and any content that you post or share on the Platform.

2.2 You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use of the Platform.

2.3 You must not use the Platform to post, upload, or transmit any content that is unlawful, defamatory, threatening, harassing, obscene, offensive, or otherwise objectionable.

2.4 You must not use the Platform to engage in any activity that is fraudulent, misleading, or that impersonates any person or entity.

2.5 You must not use the Platform to send unsolicited messages or to spam other users.

3. Inappropriate Content

3.1 We do not allow the posting of any content on the Platform that is illegal, discriminatory, hateful, or that incites violence or promotes terrorism.

3.2 We reserve the right to remove any content that we deem to be inappropriate or offensive, or that violates these Terms or our Privacy Policy.

4. Child Safety and CSAM Compliance

4.1 We expressly prohibit any form of Child Sexual Abuse and Exploitation (CSAE) on the Platform.

4.2 Users can report concerns directly within the app via content reporting features (flag buttons).

4.3 Upon becoming aware of any CSAM, we will promptly remove it in accordance with our policy and applicable laws.

4.4 We comply with all applicable child protection and safety laws and regulations.

4.5 Our systems automatically scan all ingested content against CSAM.

4.6 We have appointed a designated child safety officer responsible for CSAE and CSAM compliance.

5. Profanity

5.1 The use of profanity is not permitted on the Platform.

5.2 We reserve the right to remove any content that contains profanity or other offensive language.

6. Bad Behaviour

6.1 We do not tolerate any form of bad behaviour on the Platform.

6.2 We reserve the right to take any action we deem necessary to address such behaviour.

6.3 We prohibit the creation or sharing of illegal or abusive content.

6.4 We reserve the right to remove any content that violates these Terms.

6.5 We may suspend or terminate your access if you violate these Terms.

6.6 Users may report inappropriate behaviour via our support form located here .

7. User-Generated Content

7.1 You retain ownership of any content you post on the Platform.

7.2 You grant us a non-exclusive, royalty-free worldwide license to use such content.

7.3 You warrant that your content does not infringe third-party rights.

7.4 The Platform allows users to create and share photos, comments, and other materials.

7.5 You must have all necessary rights to share such content.

7.6 Content must be lawful and compliant with these Terms.

7.7 We may monitor or remove user-generated content.

7.8 We are not responsible for user-generated content posted by others.

8. Disclaimer of Warranties

8.1 We make no warranties regarding the Platform.

8.2 We do not guarantee accuracy or completeness of content.

8.3 We disclaim liability for losses arising from use of the Platform.

8.4 THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

9. Limitation of Liability

9.1 We are not liable for indirect or consequential damages.

9.2 Our liability is limited to the amount paid by you, if any.

9.3 OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU.

10. Termination

10.1 We may suspend or terminate your access at any time.

10.2 Upon termination you must cease using the Platform.

11. Governing Law and Jurisdiction

11.1 These Terms are governed by the laws of The Commonwealth of Australia.

11.2 Disputes shall be handled in Australian courts.

12. Changes to these Terms

12.1 We may modify these Terms at any time.

12.2 Continued use of the Platform constitutes acceptance of changes.

13. Miscellaneous

13.1 These Terms constitute the entire agreement between you and us.

13.2 If any provision is invalid, the remaining provisions remain in force.

13.3 Failure to enforce any right is not a waiver.

13.4 We may assign these Terms without notice.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Platform.
